Designation of the Data Protection Officer is mandatory from 25 May 2018, in accordance with articles 37 – 39 of the General Data Protection Regulation, if the controller or processor:
- is a public authority or body, except for courts acting in their judicial capacity;
- the core activities consist of processing operations which require regular and systematic monitoring of data subjects on a large scale;
- the core activities of the controller or the processor consist of processing on a large scale of special categories of data or personal data relating to criminal convictions and offences (such as: data on racial or ethnic origin, religious beliefs, trade union membership, genetic, biometric and health data) or relating to criminal convictions and offences.
